For The 2023 [Laws Whiskey House Distiller for a Day Contest] on Gleam

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Please read these Official Rules before entering The 2023 [Laws Distiller for a Day Contest] on Gleam (the “Sweepstakes”), presented by Gargoyle Enterprises, Inc., d/b/a Laws Whiskey House (“Sponsor”). By entering the Sweepstakes, you agree to the terms of these Official Rules and represent and warrant that you meet the eligibility requirements herein. These Official Rules shall govern in the event of any inconsistency with other Sweepstakes-related materials. Gargoyle Enterprises, Inc. is the sole sponsor of this Sweepstakes, which is no way (i) sponsored by, endorsed by, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social media platforms or networks (the “Social Networks”) that are used to share the Sweepstakes, or (ii) sponsored, endorsed, or administered by Crowd9 PTY LTD (“Gleam”).

2. CONTEST PERIOD: This Contest begins on May 1, 2023 at 8:00 AM Mountain Time (“MT”) and ends on August 31, 2023 at 11:59:59 PM MT (“Contest Period”). All eligible Entries must be received by August 31, 2023 at 11:59:59 PM MT. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

3. HOW TO ENTER (collectively, the “Entry”):
You may enter in any of the following ways:

(a) Enter via: [https://lawswhiskeyhouse.com/distiller-contest] or by scanning the QR code on your phone or mobile device that is displayed on Sponsor’s authorized Sweepstakes materials at participating locations, and complete all required actions;

(b) Subscribe to the Laws Whiskey House newsletter and complete all required actions;

(d) Visit @lawswhiskey on Instagram and complete all required actions;

(e) Visit Laws Whiskey House’s Facebook page and complete all required actions; or

(f) Visit Laws Whiskey House’s YouTube Page and complete all required actions.

Any incomplete Entries will not be considered and will be disqualified, in the sole discretion of Sponsor. All information contained in an Entry is subject to Gleam’s Terms of Use (available at https://gleam.io/terms) and Privacy Policy (https://gleam.io/privacy), as well as Sponsor’s Terms of Use (available at https://lawswhiskeyhouse.com/terms-of-use/) and Privacy Policy (available at https://lawswhiskeyhouse.com/privacy-policy-2/). Failure to follow any instructions provided by the Gleam Platform or to submit your Entry within the applicable Contest Period may result in disqualification. The time of receipt of any valid Entry shall be the time such valid Entry becomes available to Sponsor on the Gleam platform (the “Gleam Platform”). Sponsor’s computer shall be the official clock of the Sweepstakes. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Sweepstakes, your submission may be disqualified at the sole discretion of Sponsor.

4. ELIGIBILITY: Open to legal residents of the United States and D.C. (excluding Rhode Island), 21 years of age and older as of May 1, 2023, except for[1] (i) employees, officers, directors, and agents of Sponsor, Gleam, agencies involved in the promotion or administration of the Sweepstakes, and their respective affiliates, subsidiaries, and agencies (collectively “Promotion Parties”), (ii) family members (regardless of where they reside) and those living in the same household (whether or not related) of the foregoing, and (iii) any other parties prohibited by applicable law (including, as applicable, authorized licensees, retail licensees, licensed distributors, or wholesale licensees subject to regulation by an applicable state alcohol and beverage agency), or employees, officers, directors, and agents thereof. For purposes of this paragraph, “family member” means a spouse, parent, sibling, child, son-in-law, daughter-in-law, and all lineal descendants, including those by adoption. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

5. PRIZE: Sponsor will be giving away one (1) trip [2] to Laws Whiskey House in Denver, Colorado to be a “distiller for a day,” as follows (the “Prize”):

· Economy class airfare for two (2) people to Denver, Colorado, on an airline of Sponsor’s choosing (approximate retail value $[1,200]);

· Two (2) nights hotel stay in Denver, Colorado, at a hotel of Sponsor’s choosing (approximate retail value $[900];

· Meals for two (2) people for the duration of the trip (approximate retail value $[800]);

· Entertainment and tours for (2) people (approximate retail value [$720];

· Pre-paid AMEX or Visa gift card for spending money [$200];

· Private tour of the Laws Whiskey House distillery (approximate retail value $100); and

· Selected Laws Whiskey House gear and other non-alcoholic merchandise (approximate retail value $[600]).

Total Prize value: Up to $[5,000]. The trip must occur between September 12, 2023 and November 17, 2023, unless otherwise agreed to by Sponsor in its sole discretion. The specific dates will be agreed to by the winner and Sponsor. Unless otherwise agreed to by Sponsor in its sole discretion, Sponsor will make reservations for any airfare and hotel stays directly. Prize consists of only those items specifically listed above. Only one (1) Prize will be awarded. Any and all Prize-related expenses (except those expressly set forth above) will be the sole responsibility of the winner, including, without limitation, any and all federal, state, and/or local income taxes. No substitution or transfer of the Prize permitted by the winner. Sponsor reserves the right to substitute a Prize of equal or greater value. All Prizes will be awarded. If a potential winner is disqualified for any reason, Sponsor will award the Prize to an alternate winner by random drawing from among all remaining eligible Entries. Only three alternate drawings will be held, after which the Prize will remain un-awarded. The winner will be issued an IRS Form 1099 in the amount of the actual retail value of the Prize and must provide the Sponsor with his/her valid Social Security Number or Taxpayer ID for tax reporting purposes prior to being awarded the Prize.

6. RIGHTS GRANTED BY ENTRANT: By entering this Sweepstakes, you understand and agree that Sponsor and anyone acting on behalf of Sponsor or its respective licensees, successors, and assigns has the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, the your Entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering the Sweepstakes, you represent and warrant that your Entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your Entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Sponsor. If the content of your Entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend against or settle such claims. You shall indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense which the Sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

7. ENTRY REQUIREMENTS: Limit one (1) Entry per person. By entering, you agree to waive any rights you may have to the Entry submitted. The Entry, or portion thereof, must not contain obscene, profane, lewd, defamatory or inappropriate content, or be disparaging to Sponsor, as determined in Sponsor’s sole discretion. Entries must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Any Entry or portion thereof that is, in Sponsor’s sole discretion, obscene, profane, lewd, defamatory, inappropriate, disparaging, offensive or contains proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and you may be disqualified. Potential winners acknowledge and agree that their Entries become the property of Sponsor, which thereby has the right to edit, adapt, modify, create derivatives of, reproduce, promote and otherwise use Entries in any way it sees fit. Automated, script, macro or robotic Entries submitted by individuals will be disqualified. Any Entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified.

8. DRAWING: A random drawing will be conducted on or about September 4, 2023 under the supervision of Sponsor to select one (1) winner from among all eligible Entries received. Odds of winning depend on the number of Entries received. The potential winner will be notified using the contact information provided by the potential winner on the Gleam Platform within seven (7) days of the winner selection. The winner may be required to claim the Prize via the email address provided by the winner on the Gleam Platform. The potential winner must claim the Prize and sign and return any required Affidavit of Eligibility and Release within seven (7) days of the date the notification was sent. If the winner cannot be contacted, is ineligible, fails to claim the Prize within seven (7) days of the date the notification was sent, or fails to timely return a completed and executed Affidavit of Eligibility and Release as required, the Prize may be forfeited and an alternate winner selected in accordance with these Official Rules. Receipt of the Prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these Official Rules by the winner will, at the Sponsor’s sole discretion, result in the winner’s disqualification as winner, and all privileges as winner will be immediately terminated. By entering this Sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. Acceptance of a Prize also constitutes permission to the Promotion Parties to use the winner’s name and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

9. LIMITATION OF LIABILITY: By entering this Sweepstakes, you release, waive all right to, and agree to hold the Promotion Parties, as well as their respective officers, directors, employees, and officers (collectively, “Releasees”), harmless from and against, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), injury (including to persons or property) or expense (including attorneys’ fees and costs) arising out of or in connection with (i) your participation in this Sweepstakes, (ii) the acceptance, use, or misuse of any Prize, (iii) unauthorized human intervention in any part of the Sweepstakes; (iv) electronic or human error in the administration of the Sweepstakes or the processing of Entries; (v) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) printing errors; and/or (viii) lost, late, postage due, misdirected, or undeliverable mail. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ENTRANTS WAIVE THE RIGHT TO PUNITIVE, CONSEQUENTIAL, DIRECT, OR INDIRECT DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Promotion Parties will not be responsible for: late, incomplete, or incorrect Entries; an entrant’s failure to receive Prize notices due to entrant’s security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the Entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the Prizes. If, in Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel or modify this Sweepstakes in a manner deemed appropriate by Sponsor. In the event of termination, winners will be selected from among all eligible Entries received as of date of termination, as set forth elsewhere in these Official Rules.

10. INDEMNIFICATION: You shall indemnify and hold the Releasees harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Releasees due to or arising out of your participation, or your conduct in creating an Entry or otherwise in connection with, the Sweepstakes.

11. DISCLAIMER: The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, the Social Networks, and in no instance shall the Social Networks and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors be liable for any disputes, claims, causes of action or controversies arising out of or in connection with the Sweepstakes.

12. CHOICE OF LAW AND FORUM: Entrant agrees that all matters, claims, and disputes arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any of its conflict of laws provisions. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Sweepstakes and these Official Rules shall be brought exclusively in a federal or state court located in Denver, Colorado that has subject matter jurisdiction over the dispute.

14. WINNERS LIST: For the names of all Prize winners, available after September [15], 2023, send a self-addressed, stamped #10 envelope within four (4) weeks of the end of the Contest Period to: [Win Tickets to [Laws Whiskey House Distiller for a Day Contest] Winners List c/o Gargoyle Enterprises, Inc., 1325 S.
