Unless otherwise stated, Gleam Giveaway Finder is not affiliated with this giveaway.

• Agreement to the Terms. Your participation in the Giveaway is subject to these Terms, as well as any policies of the Platform(s).   We explicitly reserve the right to void or disqualify any entrant or entry if we are entitled to do so under these Terms or applicable laws. To the extent there is any conflict between these Terms and any terms and conditions specified outside of this page in connection with this Giveaway, the relevant conflicting terms found on this page shall prevail.
• Eligibility. In addition to any other eligibility restrictions as set out in the Giveaway Page, to participate in this Giveaway, you:

1. must be 18 years old or older,
2. must be a registered member with your own account with the Platforms where you participated in the Giveaway,
3. must not be an employee or family member of an employee of ours or be directly associated with the administration of the Giveaway in any way.
4. must not be a resident of Colombia, Italy, Hong Kong, Russia, Ukraine, Cuba, Iran, North Korea, Sudan, or Syria.

• Giveaway Period. The Giveaway begins on May 2nd 2024, 7pm CET and ends on May 12th 2024, 11:59pm CET (the “Giveaway Period”).

• How to enter: Instructions on how to enter the Giveaway are provided by us on our official Giveaway page at the following URL: https://gleam.io/HSkNd/den-of-wolves-x-hyperx-giveaway (the “Giveaway Page”). 

To participate in the Giveaway, you must comply with the instructions provided by us on the Giveaway Page. The entry must fulfill all requirements of the Giveaway, as specified, to be eligible to win a Prize. Entries that are incomplete or do not adhere to the rules or specifications of the Giveaway may be disqualified. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Giveaway, your submission may be disqualified. Without limiting the foregoing, we explicitly reserve the right to void or disqualify any entrant or entry if it believes in good faith any entrant or entry does not comply with the Terms.

• Prize(s). The prize for winning the Giveaway (the “Prize”) consists exclusively of the following items:

• WINNERS MAY BE REQUIRED TO FURNISH PROOF OF IDENTITY, ADDRESS AND BIRTH DATE IN ORDER TO RECEIVE A PRIZE. Winners may be required to complete relevant tax forms as a condition of the delivery of the applicable Prize. Winners may be required to report income to their relevant tax authority and shall be fully and completely responsible for paying any and all federal, state, and local taxes associated with the value of their winnings whether or not we properly report winnings to tax authorities or not.

• Winner selection and notification.

• A total number of five (5) winners (each a “Winner”) will be selected by random draw from all eligible entries of the Giveaway on May 13th 2024

• The Winner will be notified via Winner’s provided social media handle or email address as soon as reasonably practical following the draw, usually within seven (7) days of the drawing the Winner.

• The Winner must claim the Prize by responding to our notification and providing relevant authentication information within seven (7) days of being notified that they are a Winner.

• Prize Provision and Delivery: We endeavour to deliver the Prize to the Winner within 30 days of us receiving the relevant information as set out above.

• Use of Name/Likeness. 10C and their designees and assigns may, subject to their compliance with applicable laws, including GDPR, use the participant’s Giveaway submission, as well as their name (shortened), social handle, and/or visual likeness shared in connection with their submission, for advertising purposes without further compensation (financial or otherwise).
• Personal Information Notice. By submitting your entries, you understand that we will process your name, email address, social media handles, and any other information disclosed during your communications with us, pursuant to the Terms. Please refer to the Privacy Notice in the Annex to learn how we process your Personal Data.
• Limitation of Liability.  Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our wilful intent or negligence; (ii) fraud or fraudulent misrepresentation; (iii) damages caused by gross negligence or wilful misconduct; (iv) liability for assuming a specific guarantee, and (v) any matter in respect of which it would be unlawful for us to exclude or restrict our liability, i.e. mandatory statutory liability. Save for the foregoing our liability shall be limited as follows: we shall be liable only up to the amount of damages as typically foreseeable at the time of concluding the Terms in respect of damages caused by a slightly negligent breach of a material contractual obligation (i.e. a contractual duty the fulfilment of which is essential for the proper execution of the Terms, the breach of which endangers the purpose of the Terms and on the fulfilment of which you can regularly rely); and we shall not be liable for damages caused by a slightly negligent breach of a non-material contractual obligation. Unless otherwise explicitly provided under the Terms for the purpose of the Giveaway, you acknowledge and agree that we have no obligations related to your Platform account, and your acts on any Platform shall be resolved exclusively by you and the relevant Platform.
• General Provisions. If any provision of the Terms is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that the Terms otherwise remain in full force and effect and enforceable.  We reserve the right at our sole discretion to cancel, terminate, modify or suspend the Giveaway, including if for any reason it is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway.
• Governing Law and Arbitration. This Giveaway is governed by the laws of Sweden without reference to choice of law rules. Any dispute, controversy or claim arising out of or in connection with the Giveaway, or the breach, termination or invalidity thereof, shall be finally settled by arbitration administered by the SCC Arbitration Institute (the “SCC”). The Rules for Expedited Arbitrations shall apply unless the SCC, in its discretion, determines, taking into account the complexity of the case, the amount in dispute and other circumstances, that the Arbitration Rules shall apply. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim or to rescind this agreement or seek injunctive or any other equitable relief.
• No Affiliation with Social Media Channels. This Giveaway is in no way sponsored, endorsed, administered by, or associated with any social media platform, including without limitation, Twitter, Facebook, Instagram, YouTube, Tiktok or Discord. 

• Right to obtain from us confirmation as to whether or not we process your Personal Data and, where that is the case, access to the Personal Data and receive a copy of your Personal Data (Art. 15 GDPR);

• Right of rectification of inaccurate Personal Data concerning you (Art. 16 GDPR);

• Right to obtain from us the erasure of your Personal Data without undue delay (Art. 17 GDPR);

• Right to obtain from us restriction of processing of your Personal Data (Art. 18 GDPR);

• Right to receive your Personal Data, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit it to another third party without hindrance from us (Art. 20 GDPR);

• Right to object, on grounds relating to your particular situation, at any time to processing of your Personal which we process based on our legitimate interest or in the public interest, including profiling based on those provisions (Art. 21 GDPR).
